Question: Texas is an "at will" employment state, so we can fire someone for any reason. Right?
Answer: Wrong! There are a variety of state and federal laws which prohibit discrimination of various sorts. Protected classes include race, sex, age, disability, pregnancy, religion, military status and more. Usually (but not always!) there is a size requirement before the laws apply (e.g. 15 or more employees). See this month's HR newsletter, Human Element, from Coy Lewis for more insights. However, remember that the board of directors has the right to remove officers - all of whom serve at the will of the board. Of course, if the removal violates a law (see above), the board might be facing a lawsuit.
