Question: We have received a request from the Adult Protective Services asking for information on an elderly customer. Does this violate any privacy laws?
Answer: No! There is an exception in GLBA for compliance with other laws, regulatory investigations, etc. The Texas Human Resources Code includes section 48.154, giving the agency the authority to investigate potential cases of elder abuse. They do not have to pay a fee for the records either! On the plus side, there is explicit immunity in the code for providing this information.
