New Account Documentation: Assumed Names
Question: Our checklist indicates that we should request an assumed name certificate for commercial accounts. Our new customer says he doesn't have one because he doesn't have an assumed name. How do we know! Answer: A business basically has an assumed name if it is using a name other than its legal name (e.g. name in its Articles of Incorporation) or for a partnership or sole proprietor it is using a name that does not include the owner's last name. See section 36.02 of the Texas Business & Commerce Code for details!
