Question:  Do we have to offer our employees coffee breaks?

Answer:  The Fair Labor Standard Act does not require them.  However, the FLSA regs provide that if the breaks are 20 minutes or less, then they are compensable hours worked.  Remember that coffee or rest breaks may be important in assuring that employees stay sharp and that they do not develop occupational problems like repetitive stress syndrome.
