Question: We are lending the purchase money for a new manufactured home which will be placed on leased space. What precautions should we take? Answer: Under the Property Code, the landlord has a lien that has priority over your UCC lien. Therefore, it is critical to get a landlord's waiver before the home is installed on the property. If that is not possible, then monitor rent payments or be prepared to pay off the landlord in the (hopefully unlikely) event that you have to foreclose.
