365/360 Day Year - Residential

Question:  On first lien residential mortgage loans, may we use the 365/360 day year?
 
Answer:  Yes.  Be sure to disclose the method to avoid a complaint that the method is deceptive.  However, on second lien mortgage loans with a rate over 10%, only use actual day calculation.  Chapter 342 of the Finance Code requires that.
