Question: We have a POD account for a lady who just died. The court appointed administrator has provided us with letters of administration. He wants the funds in the account to pay the funeral expenses. Can we give them to him? Answer: No. This is not an asset of the estate. Rather, it passed by contract (POD designation). The administrator may be able to go after the new owner of the funds if the estate has insufficient assets to pay expenses. But that is not YOUR call!
