Gifts to Employees
 
Question:  At this season, some of our best customers would like to show their appreciation for outstanding service by making gifts to certain employees.  Any problem with this?
 
Answer:  Probably.  Under the Bank Bribery Act, it is a crime for anything "of value" to be given/received in exchange for a banking activity (loan, account, vendor relationship).  This law has been clarified by FDIC guidance.  http://www.fdic.gov/news/news/financial/2005/fil10505a.html  If the gift relates to a family relationship, of course it is okay.  The bank should have a good code of ethics to guide its employees.
