Question: May a husband and wife be a "sole proprietor" ?
Answer: Actually, husband and wife can have a "sole" proprietorship. If two other parties (not married) have a business relationship, then it is either a joint venture or a partnership. But in Texas, spouses do NOT own businesses together as partners but as community property. Thus, the business is a proprietorship. The word "sole" is just doggone confusing.
