NewsFDIC Comment Letters

Thanks to all of you who took the time to write the FDIC in regards to the proposed special assessment rule.  Many of you have sent copies of your letters to me and I commend you for the careful thought that was put into each.

Last week as a result of the IBAT Executive Committee's trip to Washington, several members of the Texas congressional delegation issued a letter to the FDIC relative to this proposal. You may view a copy of this letter here.  Senators Hutchison and Cornyn weighed in with letters of their own. Congressmen Hinojosa, Bernice Johnson, Edwards and Green also filed their own letter with the FDIC.

You may wish to express your thanks to your elected representative if they participated.  We all anxiously wait to see what the FDIC board decides to do on this and future assessments.  I am convinced that the community banking industry has done an excellent job  in communicating our strong objections to this proposal by the FDIC which will likely result in a substantially modified plan and lower assessment premiums.

Legal Ease Question of the Week

Legal Ease QuestionQuestion: I have two questions. First, can a lender make a home equity loan on a parcel of the homestead that is surveyed out, but does not include the house?  We were advised that because the loan was not secured by a portion of the homestead that contained the house, it would have to be made as a conventional real estate secured loan.  This brings up the second question:  What would happen if we had taken this advice and made a conventional real estate secured loan on the surveyed-out parcel of the homestead that didn't contain the house.

IBAT PAC Drive

FLagYou should have received a letter from IBAT this past week about the annual PAC Drive.  Please help our community banking industry by conducting a PAC Drive with not only your board of directors, but your employees.  To be entered in the drawing, we need:
1.    Your board members to contribute a minimum of $100 to either the IBAT PAC or the IBAT FedPAC
