FDIC Special Assessment Final Rule
Now that the dust has begun to settle on the FDIC special assessment final rule, IBAT members have been calling with questions on booking the expense. Here is what the accounting experts have concluded: the expense must be booked in the second quarter based on your June 30, 2009 numbers (total assets minus Tier 1 capital). Banks that have accepted TARP proceeds need not include those proceeds in the calculation. The FDIC has a set up a special assessment calculator on their website, follow this link and click on "Assessment Rate Calculator – Final Rule Effective 4/1/2009" to download the calculator: http://www.fdic.gov/deposit/insurance/initiative/Special assessments are due and payable by September 30, 2009. The FDIC Board left open the possibility of additional assessments to be imposed on the industry should the Deposit Insurance Fund near zero or if in the opinion of the Board, depositor confidence in the system is eroding.
While we will continue to advocate that the FDIC use its new increased borrowing authority from Treasury to fund further capitalization of the DIF, it may be prudent for you and your Board to consider an accrual up to an additional 5bp for the fourth quarter of 2009. No special assessments have been authorized past December 31, 2009.

As is customary, sometimes the greatest achievements can be measured in bills that did not pass, rather than those that did. Baker Market Update
Stocks rose and bond yields drifted higher this week as economic data seemed to indicate that the worst of the recession is behind us. Friday morning saw the Labor Department’s release of employment data which showed a decline of 345,000 non-farm payrolls, substantially less than the consensus projections and the smallest decline in eight months.
