Regulatory Burden Relief Moving Forward - H.R. 3505, the Financial Services Regulatory Relief Act of 2005, provides some meaningful relief to all in the financial services sector, with specific relief targeted to community banks. Action in the House is expected this Fall. The credit union industry is attempting to add some of their pet issues to this bill, and we of course are less-than-pleased with that development. IBAT has relayed our strong feelings on this issue to all of the members of the House Financial Services Committee. If you are a constituent of one of the Texas members of this committee (Hensarling, Neugebauer, Paul, Hinojosa, Al Green) it would be helpful for you to reinforce this position. On Tuesday we sent out a Special Compliance Bulletin about the lawsuit in state district court attacking the interpretive rulings issued by the Finance Commission and the Credit Union Commission that left home equity lending in a state of flux. Today the Finance Commission unanimously passed a resolution to file a request for reconsideration, file an appeal, seek a stay of enforcement, and pursue any other legal means available to keep the interpretive rules in effect until all appeals have been exhausted. In the meantime, we suggest you follow the suggestions in the Special Compliance Bulletin regarding home equity lending.
