Pre-Session Activity
Although the next regular session of the Texas Legislature does not start until January 9, 2007, legislators are already pre-filing bills (as permitted by law).  Over 500 are in the hopper so far.  IBAT has over a dozen of these in its tracking list!  As the activity heats up, IBAT will provide regular Capitol Reports as part of the weekly e-newsletter to keep you informed of developments.

Bad News from the Supreme Court
In the November 13, 2006 edition of this newsletter we provided you with a copy of the Amicus Brief that IBAT filed in the Texas Supreme Court in the case of Citizens Bank of Texas v. Wells Fargo Bank, N.A.  To our disappointment, we learned that on December 1, 2006, the Texas Supreme Court refused to hear the writ for review of this case, leaving stand the Court of Appeals decision in favor of Wells Fargo.
     As we mentioned in our previous newsletter on this case, IBAT receives calls from members involving kites or other losses, such as a failure to give  timely notice of a return of a large item, where a loss has been caused by a mega-bank's failure to follow the rules.  In spite of the setback of the Citizens Bank of Texas v. Wells Fargo Bank, N.A. case, IBAT is still interested in learning the details of any similar situations involving losses that our members have incurred as a result of dealing with a mega-bank. We will continue to work with the bank regulators and explore legislative remedies to resolve this unfair treatment of community banks.
