Question:  Our bank has a practice of allowing non-exempt employees to take vacation before they actually accrue it.  Likewise, if the employee terminates before the employee accrues their vacation, it has been the practice to deduct from their final pay the amount equal to the non-accrued vacation.  Can we do this?
     Answer:   Yes, so long at you have ensured that you do two things. First, the amount of the deduction cannot drop the employee’s final pay below the minimum wage as established by the Fair Labor Standards Act. Second, under State Statutes, you must secure an authorization from the employee to deduct that amount. Otherwise you could incur a Texas Payday violation.
